This Privacy Policy (“Policy”) describes the policies and procedures on the collection, use, disclosure and protection of your information when you use our website located at www.ovalstars.com and it’s subdomains including its customer interface channels, mobile site, mobile app & offline channels including call centers and offices (collectively, “Platform”) made available by Ovalstars Entertainment Private Limited (“Ovalstars”, “Company”, “we”, “us” and “our”),  a company incorporated under the Companies Act 2013, having its registered office at 306, Union Heights, Maharana Pratap Road, Vesu, Surat (Gujarat) INDIA - 395007.


We recognize the importance of privacy of our users and also of maintaining confidentiality of the information provided by its users as a responsible data controller and data processer.


The terms “you”, “users” and “your” refer to the user of the Platform. The term “Services” refers to any services offered by the Company whether on the Platform or otherwise.


Please read this Policy before using the Platform or submitting any personal information to us. If you disagree with this Privacy Policy please do not use or access our Platform or other Sales Channels. This Policy is a part of and incorporated within, and is to be read along with, the Terms of Use Policy.


YOUR CONSENT


Please note that the data shared with OVALSTARS shall be primarily processed in India and such other jurisdictions where a third party engaged by OVALSTARS may process the data on OVALSTARS’s behalf. By using the Platform and the Services, you agree and consent to the collection, transfer, use, storage, disclosure and sharing of your information as described and collected by us in accordance with this Policy.  If you do not agree with the Policy, please do not use or access the Platform. The data protection regulations in India or such other jurisdictions mentioned above may differ from those of your country of residence.


POLICY CHANGES


We may occasionally update this Policy and such changes will be posted on this page. If we make any significant changes to this Policy, we will endeavour to provide you with reasonable notice of such changes, such as via prominent notice on the Platform or to your email address on record and where required by applicable law, we will obtain your consent. To the extent permitted under the applicable law, your continued use of our Services after we publish or send a notice about our changes to this Policy shall constitute your consent to the updated Policy.


LINKS TO OTHER WEBSITES


The Platform may contain links to other websites. Any personal information about you collected whilst visiting such websites is not governed by this Policy. Company shall not be responsible for and has no control over the practices and content of any website accessed using the links contained on the Platform. This Policy shall not apply to any information you may disclose to any of our service providers/service personnel which we do not require you to disclose to us or any of our service providers under this Policy.


LAWFUL USE OF ANY AND ALL INFORMATION COLLECTED


Such information shall be strictly used for the aforesaid specified & lawful purpose only. User further understands that OVALSTARS may share this information with the end service provider or any other third party for provision and facilitation of the desired booking. OVALSTARS will always redact all/any sensitive & confidential information contained in the vaccination certificate, passbook, bank statement or any other identity card submitted for the purpose of either registering yourself for being a user or  for availing a service, promotional offer or booking a product on the Platform. In case a User does not wish to provide this information or opts for deletion of the information already provided, OVALSTARS may not be able to process the desired booking request. OVALSTARS will never share any of the above information collected including PAN card details, GST Details, Vaccination status & certificate , Passport details, Aadhar Card and similar other identification documents as may be asked by Ovalstars in order to let you use our services without their prior consent unless otherwise such action is required by any law enforcement authority for investigation, by court order or in reference to any legal process.


INFORMATION WE COLLECT FROM YOU


We will collect and process the following information about you:


  • Information you give us - This includes information submitted when you:

  1. Create or update your account on the Platform, which may include your name, email, phone number, login name and password, address, payment or banking information, date of birth, profile picture, your geo location, your event geo location, your personal KYC as well your entity KYC. If you sign into the Platform through third-party sign-in services such as Facebook, Google Plus or Gmail or any other social networking or similar site (collectively, “SNS”), an option of which may be provided to you by the Company at its sole discretion, you will be allowing us to pass through and receive from the SNS your log-in information and other user data; or

  2. Provide content to us, which may include reviews, booking details and history, comments, feedbacks, favourite artists, wishlist, special merchant requests, contact information of people you refer to us and other information you provide on the Platform (“Your Content”).

  3. When You use our Services, we may collect and store information about you to process your requests and automatically complete forms for future transactions, including (but not limited to) your phone number, address, email, billing information and credit or payment card information.

  4. Correspond with the Company for customer support;

  5. Participate in the interactive services offered by the Platform such as discussion boards, promotions or surveys, other social media functions or make payments etc., or

  6. Enable features that require the Company/Platform access to your address book or calendar;

  7. Report problems for troubleshooting.

  8. If you sign up to use our Services as a merchant or partner, we may collect location details, copies of government identification documents and other details (KYC), call and SMS details.

  • Information we collect about you - With regard to each of your visits to the Platform, we will automatically collect and analyse the following demographic and other information and documents including but not limited to:

  1. When you communicate with us (via email, phone, through the Platform or otherwise), we may maintain a record of your communication;

  2. Transactional history (other than banking details) about your e-commerce activities, buying behaviour.

  3. Your usernames, passwords, email addresses and other security-related information used by you in relation to our Services.

  4. Data either created by you or by a third party and which you wish to store on our servers such as image files, videos, documents etc.

  5. Data available in public domain or received from any third party including social media channels, including but not limited to personal or non-personal information from your linked social media channels (like name, email address, friend list, profile pictures or any other information that is permitted to be received as per your account settings) as a part of your account information.

  6. Information pertaining any other user(s) for who you make a booking through your registered OVALSTARS account. In such case, you must confirm and represent that each of the other user(s) for whom a booking has been made, has agreed to have the information shared by you disclosed to us and further be shared by us with the concerned service provider(s).

  7. If you request OVALSTARS to provide visa related services, then copies of your passport, bank statements, originals of the filled in application forms, photographs, and any other information which may be required by the respective embassy to process your visa application.

  8. For international bookings, Users, in compliance with the Liberalized Remittance Scheme (LRS) of RBI or any other law may be required to provide details such as their PAN information or passport details number or any such information required by Service Provider. Such information shall be strictly used as per the aforesaid requirements only. In case a User does not wish to provide this information, OVALSTARS may not be able to process the booking. OVALSTARS will never share User’s PAN details without their prior consent unless otherwise such action is required by any law enforcement authority for investigation, by court order or in reference to any legal process.

  9. Your Covid-19 Vaccination status and certificate in case you wish to avail any service for provision of which such Covid-19 vaccination related information is required or want to access your vaccination certificate at a later stage for travel related or any other purpose. OVALSTARS will never process the beneficiary id and other id details contained in the vaccination certificate.

Location information: Depending on the Services that you use, and your app settings or device permissions, we may collect your real time information, or approximate location information as determined through data such as GPS, IP address;


Usage and Preference Information: We collect information as to how you interact with our Services, preferences expressed and settings chosen. The Platform includes the Company’s advertising services (“Ad Services”), which may collect user activity and browsing history within the Platform and across third-party sites and online services, including those sites and services that include our ad pixels (“Pixels”), widgets, plug-ins, buttons, or related services or through the use of cookies. Our Ad Services collect browsing information including without limitation your Internet protocol (IP) address and location, your login information, browser type and version, date and time stamp, user agent, time zone setting, browser plug-in types and versions, operating system and platform, and other information about user activities on the Platform, as well as on third party sites and services that have embedded our Pixels, widgets, plug-ins, buttons, or related services;


Transaction Information: We collect transaction details related to your use of our Services, and information about your activity on the Services, including the full Uniform Resource Locators (URL), the type of Services you requested or provided, comments, domain names, search results selected, number of clicks, information and pages viewed and searched for, the order of those pages, length of your visit to our Services, the date and time you used the Services, amount charged, details regarding application of promotional code, methods used to browse away from the page and any phone number used to call our customer service number and other related transaction details;


Device Information: We may collect information about the devices you use to access our Services, including the hardware models, operating systems and versions, software, file names and versions, preferred languages, unique device identifiers, advertising identifiers, serial numbers, device motion information and mobile network information. Analytics companies may use mobile device IDs to track your usage of the Platform;


Stored information and files:  The mobile application (“app”) may also access metadata and other information associated with other files stored on your mobile device. This may include, for example, photographs, audio and video clips, personal contacts and address book information. If you permit the app to access the address book on your device, we may collect names and contact information from your address book to facilitate social interactions through our services and for other purposes described in this Policy or at the time of consent or collection. If you permit the app to access the calendar on your device, we collect calendar information such as event title and description, your response (Yes, No, Maybe), date and time, location and number of attendees.


  • Information we receive from other sources -

  1. We may receive information about you from third parties, such as other users, partners (including ad partners, analytics providers, search information providers), or our affiliated companies or if you use any of the other websites/apps we operate or the other Services we provide. Users of our Ad Services and other third-parties may share information with us such as the device ID, or demographic or interest data, and information about content viewed or actions taken on a third-party website, online services or apps. For example, users of our Ad Services may also be able to share customer list information (e.g., email or phone number) with us to create customised audience segments for their ad campaigns.

  2. When you sign in to Platform with your SNS account, or otherwise connect to your SNS account with the Services, you consent to our collection, storage, and use, in accordance with this Policy, of the information that you make available to us through the social media interface. This could include, without limitation, any information that you have made public through your social media account, information that the social media service shares with us, or information that is disclosed during the sign-in process.  Please see your social media provider’s privacy policy and help centre for more information about how they share information when you choose to connect your account.

USES OF YOUR INFORMATION


  • We use the information we collect for following purposes, including:

  1. While making a booking, we may use Personal Information including, payment details which include cardholder name, credit/debit card number (in encrypted form) with expiration date, banking details, wallet details etc. as shared and allowed to be stored by you. We may also use the information of travellers list as available in or linked with your account. This information is presented to the User at the time of making a booking to enable you to complete your bookings expeditiously.

  2. Personal Information may also be used for several reasons including but not limited to:

    • confirm your reservations with respective service providers;

    • keep you informed of the transaction status;

    • send booking confirmations either via sms, e-mails or Whatsapp or any other messaging service;

    • send any updates or changes to your booking(s);

    • allow our customer service to contact you, if necessary;

    • customize the content of our website, mobile site and mobile app;

    • request for reviews of products or services or any other improvements;

    • send verification message(s) or email(s);

    • validate/authenticate your account and to prevent any misuse or abuse.

    • contact you on your birthday/anniversary to offer a special gift or offer


  3. To provide, personalise, maintain and improve our products and services, such as to enabled services, enable features to personalise your account. Typically, the information received is aggregated, and used to make improvements to Website, other Sales Channels, services and to develop appealing content, features and promotions for members based on the results of the surveys. Identity of the survey participants is anonymous unless otherwise stated in the survey.

  4. To carry out our obligations arising from any contracts entered into between you and us and to provide you with the relevant information and services;

  5. To administer and enhance the security of our Platform and for internal operations, including troubleshooting, data analysis, testing, research, statistical and survey purposes;

  6. To provide you with information about services we consider similar to those that you are already using, or have enquired about, or may interest you. If you are a registered user, we will contact you by electronic means (e-mail or SMS or telephone) with information about these services;

  7. To understand our users (what they do on our Services, what features they like, how they use them, etc.), improve the content and features of our Services (such as by personalising content to your interests), process and complete your transactions, make special offers, provide customer support, process and respond to your queries;

  8. To generate and review reports and data about, and to conduct research on, our user base and Service usage patterns;

  9. To allow you to participate in interactive features of our Services, if any; or

  10. To measure or understand the effectiveness of advertising we serve to you and others, and advertising to you.

  11. Marketing promotions, research and programs help us to identify your preferences, develop programs and improve user experience. OVALSTARS frequently sponsors promotions to give its Users the opportunity to win great prizes. Personal Information collected by us for such activities may include contact information and survey questions. We use such Personal Information to notify contest winners and survey information to develop promotions and product improvements. As a registered User, you will also occasionally receive updates from us about promo sales in your area, special offers, new OVALSTARS services, other noteworthy items (like currently trending artists or acts, deals of the day week or month, Ovalstars Hot 20 List, and other services relation to either booking a service provider or their peripheral services) and marketing programs. In addition, you may look forward to receiving periodic marketing emails, newsletters and exclusive promotions offering special deals.

We may combine the information that we receive from third parties with the information you give to us and information we collect about you for the purposes set out above.  Further, we may anonymize and/or de-identify information collected from you through the Services or via other means, including via the use of third-party web analytic tools. As a result, our use and disclosure of aggregated and/or de-identified information is not restricted by this Policy, and it may be used and disclosed to others without limitation.


We analyse the log files of our Platform that may contain Internet Protocol (IP) addresses, browser type and language, Internet service provider (ISP), referring, app crashes, page viewed and exit websites and applications, operating system, date/time stamp, and clickstream data. This helps us to administer the website, to learn about user behaviour on the site, to improve our product and services, and to gather demographic information about our user base as a whole.


DISCLOSURE AND DISTRIBUTION OF YOUR INFORMATION


We may share your information that we collect for following purposes:


  • With Service Providers: We may share your information with our vendors, consultants, marketing partners, research firms and other service providers or business partners, such as Payment processing companies, to support our business. For example, your information may be shared with outside vendors to send you emails and messages or push notifications to your devices in relation to our Services, to help us analyse and improve the use of our Services, to process and collect payments. We also may use vendors for other projects, such as conducting surveys or organising sweepstakes for us.

  • With Other Users: If you are a partner, we may share your name, phone number and/or profile picture (if applicable), tracking details with other users to provide them the Services.

  • For Crime Prevention or Investigation: We may share this information with governmental agencies or other companies assisting us, when we are:

  • Obligated under the applicable laws or in good faith to respond to court orders and processes; or

  • Detecting and preventing against actual or potential occurrence of identity theft, fraud, abuse of Services and other illegal acts;

  • Responding to claims that an advertisement, posting or other content violates the intellectual property rights of a third party;

  • Under a duty to disclose or share your personal data in order to enforce our Terms of Use and other agreements, policies or to protect the rights, property, or safety of the Company, our customers, or others, or in the event of a claim or dispute relating to your use of our Services. This includes exchanging information with other companies and organisations for the purposes of fraud detection and credit risk reduction.

  • For Internal Use: We may share your information with any present or future member of our “Group” (as defined below) or affiliates for our internal business purposes The term “Group” means, with respect to any person, any entity that is controlled by such person, or any entity that controls such person, or any entity that is under common control with such person, whether directly or indirectly, or, in the case of a natural person, any Relative (as such term is defined in the Companies Act, 1956 and Companies Act, 2013 to the extent applicable) of such person.

  • With Advertisers and advertising networks: We may work with third parties such as network advertisers to serve advertisements on the Platform and on third-party websites or other media (e.g., social networking platforms). These third parties may use cookies, JavaScript, web beacons (including clear GIFs), Flash LSOs and other tracking technologies to measure the effectiveness of their ads and to personalise advertising content to you. 

While you cannot opt out of advertising on the Platform, you may opt out of much interest-based advertising on third party sites and through third party ad networks (including DoubleClick Ad Exchange, Facebook Audience Network and Google AdSense). OVALSTARS uses cookies to personalize your experience on the Platform and the advertisements that maybe displayed. OVALSTARS’s use of cookies is similar to that of any other reputable online companies.

Such cookies are used for purposes of tracking the effectiveness of advertising served by us on any platform, and also to use aggregated statistics about your visits to the Platform in order to provide advertisements on the Platform or any other website or app, about services that may be of potential interest to you. This anonymous information is collected through the use of a pixel tag, which is an industry standard technology and is used by all major websites and platforms. They may use this anonymous information about your visits to the Platform in order to provide advertisements about goods and services of potential interest to you. OVALSTARS supports your right to block any unwanted Internet activity, especially that of unscrupulous websites. However, blocking OVALSTARS cookies may disable certain features on the Website, and may hinder an otherwise seamless experience to purchase or use certain services available on the Website. Please note that it is possible to block cookie activity from certain websites while permitting cookies from websites you trust.


Automatic Logging of Session Data:


Each time you access the Website or App your session data gets logged. Session data may consist of various aspects like the IP address, operating system and type of browser software being used and the activities conducted by the User while on the Platform. We collect session data because it helps us analyze User’s choices, browsing pattern including the frequency of visits and duration for which a User is logged on. It also helps us diagnose problems with our servers and lets us better administer our systems. The aforesaid information cannot identify any User personally. However, it may be possible to determine a User's Internet Service Provider (ISP), and the approximate geographic location of User's point of connectivity through the above session data.


USER GENERATED CONTENT


OVALSTARS provides an option to its users to post their experiences by way of reviews, ratings and general poll questions. The customers also have an option of posting questions w.r.t a service offered by OVALSTARS or post answers to questions raised by other users. OVALSTARS may also hire a third party to contact you and gather feedback about your recent booking with OVALSTARS. Though the participation in the feedback process is purely optional, you may still receive emails, notifications (app, sms, email, Whatsapp or any other messaging service) for you to share your review(s), answer questions posted by other users or a. The reviews may be written or in an image or video format. The reviews written or posted may also be visible on other users and other related platforms.


The UGC that OVALSTARS collects may be of the following kinds:


  • Review and Ratings

  • Question and Answers

  • Crowd Source Data Collection (poll questions).

Each User who posts review or ratings, Q&A, photographs shall have a profile, which other Users will be able to access. Other Users may be able to view the number of bookings, reviews written, questions asked and answered and photographs posted.


DATA SECURITY PRECAUTIONS


We have in place appropriate technical and security measures to secure the information collected by us.


We use vault and tokenization services from third party service providers to protect the sensitive personal information provided by you. The third-party service providers with respect to our vault and tokenization services and our payment gateway and payment processing are compliant with the payment card industry standard (generally referred to as PCI compliant service providers). You are advised not to send your full credit/debit card details through unencrypted electronic platforms. Where we have given you (or where you have chosen) a username and password which enables you to access certain parts of the Platform, you are responsible for keeping these details confidential. We ask you not to share your password with anyone.


Please be aware that the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted through the Platform. Once we have received your information, we will use strict physical, electronic, and procedural safeguards to try to prevent unauthorised access.


HOW LONG DO WE KEEP YOUR PERSONAL INFORMATION?


OVALSTARS will retain your Personal Information on its servers for as long as is reasonably necessary for the purposes listed in this policy. In some circumstances we may retain your Personal Information for longer periods of time, for instance where we are required to do so in accordance with any legal, regulatory, tax or accounting requirements.


Where your personal data is no longer required we will ensure it is either securely deleted or stored in a way which means it will no longer be used by the business.


OPT-OUT


When you sign up for an account, you are opting in to receive emails from the Company. You can log in to manage your email preferences or you can follow the “unsubscribe” instructions in commercial email messages, but note that you cannot opt out of receiving certain administrative notices, service notices, or legal notices from the Company.


If you wish to withdraw your consent for the use and disclosure of your personal information in the manner provided in this Policy, please write to us at privacy@ovalstars.com. Please note that we may take time to process such requests, and your request shall take effect no later than 30 (Thirty) business days from the receipt of such request, after which we will not use your personal data for any processing unless required by us to comply with our legal obligations. We may not be able to offer you any or all Services upon such withdrawal of your consent.


THIRD PARTY WEBSITES (Linked to Our Platform in any manner)


This Privacy Policy does not apply to any website(s), mobile sites and mobile apps of third parties, even if their websites/products are linked to our Platform. User should take note that information and privacy practices of OVALSTARS’s business partners, advertisers, sponsors or other sites to which OVALSTARS provides hyperlink(s), may be materially different from this Privacy Policy. Accordingly, it is recommended that you review the privacy statements and policies of any such third parties with whom they interact.


YOUR RIGHTS QUA PERSONAL INFORMATION


You may access your Personal Information from your user account with OVALSTARS. You may also correct your personal information or delete such information (except some mandatory fields) from your user account directly. If you don’t have such a user account, then you write to privacy@ovalstars.com.

However, if such processing of data is essential for us to be able to provide service to you, then we may not be able to serve or confirm your bookings after your withdrawal of consent. For instance, if you want to book any international artist, or for booking Indian artists for events outside India, then certain more informations like your PAN card, TAN, address details, GST details, etc which we may require in order to fulfil the booking specific attention or facility etc. may have to be shared by us with our service providers, partners and vendors in each city where the service will be provided, and they may further process this information for making suitable arrangements for the duration of the booking. Such sharing and processing of information may extend to such as airline details, hotel details, ground transfers, good transfers, food & beverages details, technical rider details, etc from which either the service provider will be travelling or staying or information about requirements which needs to be fulfilled in order to provide service as per the booking.


A withdrawal of consent by you for us to process your information may:


  • severely inhibit our ability to serve you properly and in such case, we may have to refuse the booking altogether, or

  • unreasonably restrict us to service your booking (if a booking is already made) which may further affect your booking or may compel us to cancel your booking.
